Who Pays For Preparation Of  The Lease?

In NSW unless the Lessor and Lessee agree otherwise the Lessee usually pays for their own legal costs in relation to a commercial lease as well as the Lessor’s reasonable legal costs in preparation of the Lease.

However, under the Retail Leases Act and the Residential Tenancy Act the Lessor cannot ask the Lessee to pay for legal costs incurred in preparing the Lease. The Lessor must pay these costs.
